These Terms govern your use of our website, purchases of our baking premixes and related products, and interactions with Sweet & Whisk. They comply with South African laws, including the Electronic Communications and Transactions Act, 2002 (ECTA), Consumer Protection Act, 2008 (CPA), and Protection of Personal Information Act, 2013 (POPIA).

1. Definitions
“Sweet & Whisk”, “We”, “Us”, or “Our” refers to Sweet & Whisk (Pty) Ltd, the operator of https://www.sweetandwhisk.com.

“User”, “You”, or “Customer” refers to any person accessing or using the website or purchasing products.

“Products” refers to baking premixes, baking tools, and related goods sold on the website.

“Website” refers to https://www.sweetandwhisk.com.


2. Use of the Website
2.1. Eligibility: By using this website, you confirm that you are at least 18 years old or have the consent of a parent or legal guardian. If under 18, your parent or guardian must accept these Terms on your behalf.
2.2. Permitted Use: You may view, browse, and purchase products for personal or commercial use (with prior written permission for commercial use, contact belinda@sweetandwhisk.com.
2.3. Prohibited Use: You may not:  
Use the website for unlawful purposes or in violation of South African law.  

Attempt to gain unauthorized access to the website or its systems.  

Post or transmit harmful, offensive, or defamatory content, including in reviews or comments.  

Reproduce, copy, or distribute website content without permission.
2.4. Account Security: If you create an account, you are responsible for maintaining the confidentiality of your login details and for all activities under your account. Notify us immediately of any unauthorized use at belinda@sweetandwhisk.com.


3. Product Purchases and Transactions
3.1. Product Descriptions: We strive to ensure product descriptions (e.g., baking premixes, tools) are accurate. However, we do not warrant that descriptions are free from errors or omissions.
3.2. Pricing: All prices are in South African Rand (ZAR) and include Value Added Tax (VAT) at 15%, as required by the Value Added Tax Act, 1991. Prices are subject to change without notice, but changes will not affect confirmed orders.
3.3. Payment Methods: We accept payments via EFT, credit/debit cards, and other methods listed at checkout (processed via a PCI-compliant payment gateway, e.g., Yoco). All transactions are secured with 3D Secure protocols.
3.4. Order Confirmation: Orders are confirmed via email once payment is received. You may review, amend, or cancel your order before payment confirmation.
3.5. Delivery:  
Delivery is within South Africa only, via trusted couriers (e.g., The Courier Guy).  

Standard delivery takes 2–5 business days; express options may be available.  

Shipping costs are displayed at checkout.  

We aim to deliver within 30 days, as required by the CPA. If delivery fails due to incorrect address details provided by you, you may incur additional shipping costs.
3.6. Cooling-Off Period: Under the CPA, you may cancel an order within 7 days of receiving the product without penalty, provided the product is unused and in original packaging. You are responsible for return shipping costs. Refunds will be processed within 14 days of receipt of returned goods.
3.7. Returns and Refunds:  

Faulty or damaged products may be returned within 6 months for repair, replacement, or refund, per the CPA. Contact belinda@sweetandwhisk.com to initiate a return.  

Non-defective returns are subject to our return policy.
3.8. Warranty: Products carry a 6-month implied warranty under the CPA, covering defects in materials or workmanship, unless otherwise stated.

4. Intellectual Property
4.1. All content on the website (e.g., logos, images, recipes, text) is the property of Sweet & Whisk or its licensors and is protected by South African intellectual property laws, including the Copyright Act, 1978.
4.2. You may not reproduce, distribute, or use any content for commercial purposes without prior written consent from belinda@sweetandwhisk.com.
4.3. The Sweet & Whisk name, logo, and domain (https://www.sweetandwhisk.com) are trademarks of Sweet & Whisk. Unauthorized use is prohibited.


5. Privacy and Data Protection
5.1. We collect and process personal information (e.g., name, email, delivery address) in accordance with POPIA. Our Privacy Policy details how we collect, use, and protect your data.
5.2. By using the website, you consent to the collection and use of your personal information as outlined in the Privacy Policy.

6. Limitation of Liability
6.1. To the extent permitted by law, Sweet & Whisk shall not be liable for any indirect, incidental, or consequential damages arising from your use of the website or products, including loss of profits or data.
6.2. We take reasonable steps to ensure the website is secure and free from errors, but we do not guarantee uninterrupted access or freedom from viruses. Use the website at your own risk, as per ECTA Section 43(5) and 43(6).
6.3. Our liability for defective products is limited to repair, replacement, or refund, as per the CPA.

 

7. User-Generated Content
7.1. If you post reviews, photos, or comments (e.g., via #SweetAndWhisk), you grant Sweet & Whisk a non-exclusive, royalty-free license to use, reproduce, and display such content for marketing purposes.
7.2. You warrant that your content is lawful, non-defamatory, and does not infringe on third-party rights. We may remove content that violates these Terms.

 

8. Dispute Resolution
8.1. Any disputes arising from these Terms or your use of the website will be resolved through negotiation or, if necessary, arbitration under the Arbitration Act, 1965, in Cape Town, South Africa.
8.2. If arbitration is required, an arbitrator will be appointed by agreement or by the Arbitration Foundation of Southern Africa (AFSA). The arbitration will be conducted informally and concluded within 21 business days, where possible.
8.3. You consent to the jurisdiction of the Cape Town Magistrate’s Court for any legal proceedings, but we may pursue proceedings in the High Court if necessary.
8.4. You may also refer disputes to the Consumer Goods and Services Ombud (www.cgso.org.za) (www.cgso.org.za) for resolution under the CPA.

 

9. Governing Law
These Terms are governed by the laws of the Republic of South Africa.
